LYNN ? A Lynn man who police arrested after a fight erupted at a family party said Tuesday he didn?t start the fight.
Instead, Scott Gillette, 45, said his son and his nephew attacked him after he argued with his son about music at the Sunday party.
?I didn?t like the music,? Gillette said. I said I?m out of here, and, boom, I got punched in the face, it?s just unbelievable My sister got in the way, that was how she was on the ground it started with a sucker punch to me.?
Four police vehicles responded to a report of a fight at 229A Lynnfield St., at approximately 9:32 p.m. Sunday, according to a police report by Lynn Police Officer Greg Brotherton.
Police arrested Gregory Gillette, 24, of 323 Lynnfield St., Scott Gillette?s son, and Travis Bird, 23, of 229A Lynnfield St., Gillette?s nephew, and charged each with assault and battery and assault and battery with a dangerous weapon, a shod foot, on Sunday at 10:22 p.m.
Scott Gillette, 45, of 610 Lynnfield St., was charged with assault and battery.
Bird told police the incident began when he saw Scott Gillette push Bird?s mother, according to the police report.
Scott Gillette told police he got into an argument with his son, Gregory Gillette, and then Bird and his son ?teamed up and assaulted him by punching and kicking him,? Brotherton wrote. Brotherton noted that Scott Gillette had ?several minor cuts and abrasions to his head, face, neck and upper body.?
Scott Gillette told The Daily Item Tuesday that he was ?fighting for his life? and that his sister was knocked over when people were trying to break up the fight, and he was trying to get away from his son.
Scott Gillette?s wife, Cindy Gillette, backed up his claim that Greg Gillette ?sucker-punched? his father.
Cindy Gillette, however, said she told police that ?she did not know who had thrown the first punch,? according to the police report, because she ?didn?t think that anyone would get arrested.?
?He?s no angel, he?s been in trouble before, but this is not his fault,? Cindy Gillette said of her husband.
The police report noted ?all parties appeared to be intoxicated.?
Neither Travis Bird nor his mother responded to messages left at the home Wednesday.
Lynn Police and Essex County District Attorney Jonathan Blodgett?s office said they could not comment on an ongoing investigation.
Judge Stephen Abany ordered the men released on personal recognizance and $40 bail at their arraignments on Monday in Lynn District Court, according to court documents.
