European, U.S. retailers split on Bangladesh reform plan

DHAKA (Reuters) - Major U.S. retailers, including Gap Inc, declined to endorse an accord on Bangladesh building and fire safety backed by Europe's two biggest fashion chains, a trans-Atlantic divide that may dilute garment industry reform efforts.

Three weeks after the collapse of a building housing garment factories, which killed more than 1,100 people, Western brands that rely on Bangladesh to produce clothing cheaply disagreed over how best to ensure worker safety.

Gap said it was ready to sign on "today" to an agreement already endorsed by European companies, including Italian clothing retailer Benetton, Britain's Marks & Spencer, Sweden's H & M Hennes & Mauritz AB and Spain's Inditex SA, but first wanted a change in the way disputes are resolved in the courts.

"With this single change, this global, historic agreement can move forward with a group of all retailers, not just those based in Europe," Eva Sage-Gavin, an executive in Gap's global human resources and corporate affairs department, said in a statement.

A series of deadly incidents at factories, including a fire in November that killed 112 people, has focused global attention on safety standards in Bangladesh's booming garment industry, the world's biggest exporter of clothing after China.

Wal-Mart Stores Inc, the world's biggest retailer, called on Bangladesh to shut one factory and examine another after its own inspections found safety problems.

Major brands and retailers set a May 15 deadline to join the agreement after talks in Germany last month. As of Tuesday morning, the only U.S. company to announce it had signed on was PVH, which owns brands including Calvin Klein.

Europe accounts for about 60 percent of Bangladesh's clothing exports, so even without participation from the big U.S. retailers, the agreement may bring some change in a country that has seen at least three deadly garment factory disasters in the span of six months.

Mohammad Atiqul Islam, president of the Bangladesh Garment Manufacturers and Exporters Association, said the deal was a bit of good news in the "worst time for us".

"We believe this decision will motivate other big buyers across the West and the USA to join their hands with us," he told Reuters.

Li & Fung Ltd, which supplies dozens of major retailers, including Walmart, said it was "continuing to look at" the European pact, but declined to give details. Bangladesh is second only to China in Li & Fung's global supply chain.

"We don't think the answer is to move away from Bangladesh," Bruce Rockowitz, Li & Fung's group president and chief executive, told reporters after a shareholder meeting in Hong Kong on Tuesday.

"The answer is actually to invest more and try to make safety better and work with the government on doing a better job on monitoring buildings."

WALMART FLAGS SAFETY CONCERNS

Walmart did not say whether it planned to sign the accord. But on Monday it released an unusually blunt and detailed public statement, asking the government to halt production at Stitch Tone Apparels in Chittagong, Bangladesh, and to inspect Nassa Group's Liz Apparels Ltd factory complex in Dhaka.

Walmart said it found "structural concerns" at a factory adjacent to Stitch Tone, Dresswell Ltd, which was not part of the retailer's own supply chain. It said the Dresswell factory "appeared unstable and could cause a hazard" for workers at Stitch Tone, which was making clothes for Walmart.

Walmart said it removed its business from Stitch Tone and advised the owner not to continue production.

The inspections also found visible cracks in the wall at Liz Apparels. Walmart said it notified factory owners, the garment association and the government about the safety concern at Liz Apparels and Stitch Tone.

Nazrul Islam Majumder, chairman of the Liz Apparels factory, said there was a "very light crack on the surface of cement plaster, not on the deep of the brick" and it could be repaired with a bit of whitewash.

He said before Walmart checked out the factory, the owner had conducted an inspection with a qualified firm, which found the building to be safe.

A garment association official said Dresswell was closed after cracks were found in the four-storey building where it is based. But the official, who declined to be named because he was not authorized to speak to the media, said his group was not notified about safety concerns at Liz Apparels.

"The government of Bangladesh did the responsible thing last week by closing factories believed to be dangerous," Rajan Kamalanathan, vice president of ethical sourcing for Walmart, said in a statement. "We call on them to show the same leadership in the Stitch Tone Apparels and Liz Apparels cases, and take any actions necessary to ensure safe conditions."

Retailers routinely inspect suppliers, but several companies said after the Rana Plaza collapsed in April that they were not able to check for structural soundness.

Walmart said it hired Bureau Veritas to inspect for structural, fire and electrical safety, including checking building designs and permits as part of an expanded inspection process it launched last month.

Rana Plaza was extended to add three more floors, in violation of city building codes, according to the chief engineer of Dhaka's development authority. The day before the building collapsed, cracks were seen in the walls.

4:53 p.m. | Updated The Senate Judiciary Committee continued to plow through amendments to an immigration overhaul bill on Tuesday, revisiting border security provisions before moving on to measures related to temporary guest worker programs.

Here is a look at some of the more interesting and important amendments offered, and how they fared in committee:

? SESSIONS 4, Requiring the use of a biometric entry and exit data system at ports of entry ? Failed 6-12

Senator Jeff Sessions, Republican of Alabama, offered an amendment that would have required the implementation of a biometric entry and exit system before anyone could apply for legal status.

?The reason is very simple ? at most seaports and airports, you clock in with a system, but it?s biographic, which is easily forgeable and not secure,? Mr. Sessions said. ?This is one reason the American people have so little confidence in the promises we make.?

Democrats on the committee agreed with Mr. Sessions in broad theory ? that a biometric identification system would be effective ? but said that the logistics and cost concerns were prohibitive and that tying the legal status of undocumented workers to getting such a system up and running could delay that status indefinitely.

?We would all concede that the biometric approach is a more sophisticated and perhaps a better approach,? said Senator Richard J. Durbin, Democrat of Illinois and a member of the bipartisan group that drafted the legislation. But, he said, Mr. Sessions?s measure was ?not attainable, not affordable.?

The two Republican members of the bipartisan group who serve on the committee ? Senators Jeff Flake of Arizona and Lindsey Graham of South Carolina ? joined with their Democratic colleagues to defeat the amendment.

? SESSIONS 1, Limiting the number of nonimmigrant aliens who can work in the United States ? Failed 1-17

Mr. Sessions also offered an amendment that would have restricted the future flow of legal immigrants, effectively limiting the number of immigrants and foreign workers to 33 million over a 10-year period and the total number of green cards to 1.2 million a year.

The measure failed, 1 to 17, with only Mr. Sessions voting for his amendment.

? GRASSLEY 58, Requiring additional information in Internet job postings for H-1B eligible jobs ? Passed by voice vote

Senator Charles E. Grassley of Iowa, the ranking Republican on the committee, introduced an amendment that would require employers to post additional information about open positions online before filling a slot with a worker hired on an H-1B visa ? a visa reserved for high-skilled workers. The measure passed with a voice vote.

? HATCH 9, Increase the labor certification fee for an employment-based visa ? Passed by voice vote

Senator Orrin Hatch, Republican of Utah, offered an amendment that would increase the labor certification fee for an employment-based visa to $1,000 from $500, and put that money in a new fund that would go toward education in the STEM ? science, technology, engineering and math ? fields.

?This bipartisan amendment makes sense,? Mr. Hatch said. ?It addresses the long-term need to invest in American STEM education.?

Mr. Hatch is considered a Republican who could be persuaded to vote yes on the legislation, provided the committee votes for some of his high-tech provisions, and this amendment passed with a voice vote.

Senator Charles E. Schumer, Democrat of New York, hailed the bipartisan spirit of Tuesday?s markup in an e-mailed statement that referred to Mr. Hatch?s and Mr. Grassley?s amendments.

?These bipartisan amendments are good-faith improvements to the bill,? Mr. Schumer said. ?This is as open a process as any I?ve seen since entering the Senate, and it is making for a better bill.?

The bipartisanship did not continue into the afternoon, after a long break for the senators to attend their weekly lunches.

? GRASSLEY 67, Requiring additional audits of at least 1 percent of companies that employ workers with H-1B visas ? Failed 2-15

Mr. Grassley offered an amendment that would have required additional audits of at least 1 percent of companies that employ workers with H-1B visas. The measure failed, 2 to 15, with only Mr. Grassley and Mr. Sessions voting in favor of it.

? CRUZ 5, Increasing the cap on H-1B visas ? Failed 4-14

Senator Ted Cruz, Republican of Texas, offered an amendment that would have drastically increased the cap on H-1B visas, to 325,000 from 65,000 a year, using a market-based calculation. Many Democrats on the committee worried that Mr. Cruz was favoring high-skilled immigrants at the expense of low-skilled, lower-wage workers.

The amendment failed, 4 to 14.

? GRASSLEY 60, Requiring employers to make ?good-faith efforts? to recruit a U.S. citizen ? Failed 2-15

Mr. Grassley offered another amendment that would have required employers to make ?good-faith efforts? to recruit a United States citizen before filling a job opening with a worker on an H-1B visa.

The provision was defeated 2 to 15, with Mr. Schumer worrying that it would be hard to provide a reasonable metric for what constitutes ?good faith.? If an employer interviewed seven citizens, he said, offering a hypothetical, someone could argue that the employer should have interviewed 14 citizens.

But many of the committee members who voted no, including Senator Sheldon Whitehouse, Democrat of Rhode Island, said that the provision made sense and that they would be willing to ?work with Mr. Grassley? to improve the amendment and perhaps offer it again on the Senate floor.

Mr. Whitehouse, for instance, voted ?No, asterisk.?

Review of "Family Tree" on HBO - Eastman's Online Genealogy ...

Family-tree-hboI did not get to watch last night's premier of "Family Tree" on HBO. I rarely watch television so I do not subscribe to HBO. The program is not supposed to be a genealogy program. Instead, it is a comedy or sometimes might be called a "mockumentary." However, several reviews of last night's program have since been posted online. Most of them state the program was not very funny. You can find several reviews if you start at http://goo.gl/OWVpt.

If you were able to watch last night's episode, please write a comment at the end of this article describing your impressions of the new program. I would like to read your opinion and I am sure others would like to do the same.

The eight-episode "Family Tree"? will eventually be available from Netflix. I assume that "eventually" means after the eighth, and final, episode has been aired. I have already ordered my copy from Netflix and expect to receive it someday, but not soon.

Richard French, Ex-Air Force Lt. Colonel, 'It Was A UFO And . . . There Were Aliens Aboard It'

When Air Force Lt. Col. Richard French was a lead investigator of Project Blue Book in the 1950s, his job was to shoot down false reports of UFOs.

Given his job, French never dreamed he'd end up in Newfoundland in one day watching what appeared to him to be two extraterrestrials performing repairs on a submerged, unknown circular craft.

In Washington, D.C. a few weeks ago, the 83-year-old retired officer testified at the Citizen Hearing On Disclosure, panel of six former members of Congress about his work as a UFO debunker in 1952.

French recounted how the Newfoundland incident unfolded decades ago, in the early 1950s, after two UFOs were seen by many people off the coast of St. John's. French's superiors ordered him to look into the situation.

"They said, 'We have a UFO report and we want you to investigate it,' and that was standard for what I was doing," French told The Huffington Post. "They told me there were two of them involved and that they were deep under the water, after entering the water doing roughly 100 miles an hour.

"There were a lot of people assembled on the wharf, at least 100 standing around just looking in amazement at the water, including several local policemen."

French recalls the water was very clear and he could see two circular craft, each one about 18 feet in diameter and approximately 3 feet thick. He said the two objects were floating below the surface of the water, a couple of feet apart, not more than 20 feet from the shore. And he saw two beings in the water near the ships.

"The first thing I saw was the UFOs, and it was apparent to me that they were doing something to the craft, and I couldn't really tell what because they were on the bottom side of it and not visible to me except when they would occasionally get over to the side where I could see them. The water was fairly clear and I could see without any trouble. They weren't down at the bottom of the [seabed] -- they were about half way down."

French told HuffPost that the two beings he saw "were about 2 or 3 feet tall, light grey in color, very thin, long arms with either two or three fingers. The top of their heads was much wider than their jaw line, their eyes were very slanted and you couldn't see pupils in them. They looked the way [aliens] have been depicted in motion pictures."

As the Air Force UFO debunker watched, he says one of the ships began to rise out of the water.

"When it hit the [surface], it was going about 100 miles an hour. It then accelerated to somewhere in the neighborhood of 2,500 to 3,000 miles an hour and disappeared. It returned about 20 minutes later, slowed down to nearly a stop before it entered the water, then went down, and the two [beings] worked together.

"It took them about 20 minutes and then the two ships departed together, again slow when they exited the water, and immediately they sped up to a very high speed. I believe they were repairing [the ship] and tested that the repairs had been adequate, and then away they went."

Ironically, French's job at the time -- as a Project Blue Book investigator -- was to debunk UFOs. So, what kind of report did he file with Blue Book about this case he had personally witnessed?

"Needless to say, it was a fictitious report, as all of them were. I didn't really say that they were UFOs -- I said that there was something we didn't know -- some type of foreign or unrecognizable vehicle there. In other words, I weasel-worded it.

"Oh, I think without a doubt it was a UFO and I think there were aliens aboard it. There's no question in my mind that was exactly what it was, and my duty was to debunk the story, so I did my best to do so."

The events of the Newfoundland UFO and alleged aliens took place some 60 years ago, in the days before everyone had a digital camera or image-capture cell phone in their pocket. Despite the fact that there are no photographs to substantiate the report, it's still an amazing story.

So what are we to make of this? Because it's not the first time French has stirred up the UFO-ET pot.

Last year, he told HuffPost exclusively that there wasn't just one UFO crash near Roswell, N.M., in 1947 -- he said there were two.
